Where you use KDL’s diagnostic or healthcare-related services, including pathology, laboratory, radiology, imaging, health-check, home collection, tele-reporting or other diagnostic services, this Privacy Policy also explains how your Personal Data, Health Data and Diagnostic Data may be processed for providing such services and for other lawful purposes described in this Privacy Policy, including healthcare quality improvement, research, public health and scientific purposes, subject to applicable law and appropriate safeguards.
This Privacy Policy applies to patients, prospective patients, Website users, attendants, authorised representatives and other individuals whose Personal Data is collected or processed by KDL through the Website or in connection with KDL’s services.
This Privacy Policy does not apply to KDL employees or personnel using internal applications or systems. Such processing shall be governed by KDL’s separate Employee Privacy Notice and applicable internal policies.

Means information relating to an individual’s physical or mental health, healthcare, medical history, symptoms, diagnosis, treatment, prescriptions or other information relating to the individual’s health.
Healthcare Professional
Includes doctors, radiologists, pathologists and other appropriately qualified healthcare professionals involved in providing or supporting diagnostic or healthcare services.
Personal Data
Means any data about an individual who is identifiable by or in relation to such data, as applicable under the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and applicable rules and regulations.
Research
Means healthcare, medical, biomedical, clinical, epidemiological, scientific, public-health, outcomes, population-health, quality-improvement or other research or analysis undertaken for a legitimate healthcare, scientific or public-health purpose and in accordance with applicable law and applicable ethical, regulatory and professional requirements.
Research Partner
Means an institution, healthcare organisation, academic institution, pharmaceutical or biotechnology organisation, research organisation, technology provider or other entity with which KDL may collaborate for a permitted Research purpose.

Healthcare Professional and Referral Information
Information relating to referring doctors, radiologists, pathologists, hospitals, clinics, healthcare institutions or other healthcare/service providers.
Transaction and Billing Information
Information necessary for billing, payments, refunds, invoices, insurance claims and other financial or administrative purposes.
Communications
Information contained in enquiries, complaints, feedback, service requests, communications and correspondence with KDL.

Access to Health Data and Diagnostic Data within KDL shall be restricted to authorised personnel, healthcare professionals, service providers and other persons having a legitimate need to access such information for authorised purposes, subject to applicable law and appropriate confidentiality and security safeguards.

Where identifiable Personal Data is required for a Research activity, KDL will process or share such information only where permitted by applicable law and subject to applicable consent, ethical, contractual, regulatory or other safeguards.
Research Partners receiving Personal Data or Diagnostic Data may be required to enter into appropriate agreements governing confidentiality, permitted use, security, onward sharing, retention, deletion, publication, incident reporting and compliance with applicable law.
Research involving human participants, identifiable health information, biological samples or other activities requiring ethical or regulatory oversight shall be undertaken subject to applicable ethical, regulatory and legal requirements.
Where required, Research activities may be subject to review or approval by an appropriately constituted Ethics Committee, Institutional Ethics Committee, Institutional Review Board or other competent authority before commencement.

Where applicable and permitted by law, biological samples collected or generated in connection with diagnostic services may be retained, processed, stored, transferred or otherwise used for quality assurance, validation, research, scientific, educational, epidemiological or other legitimate healthcare purposes, subject to applicable law, applicable consent requirements, ethical approvals and KDL’s applicable policies and procedures.
Where a biological sample or information derived from such sample is used for Research beyond the purposes reasonably contemplated at the time of collection, KDL will apply such additional consent, ethical, regulatory or other safeguards as may be required by applicable law or applicable Research requirements.
Where reasonably practicable and appropriate, KDL may use coded, de-identified or anonymised samples or information for Research purposes.
Where KDL provides or supports genetic, genomic or molecular diagnostic services, it may process genetic or genomic information and associated Health Data for providing the relevant services and, where permitted by applicable law and subject to applicable safeguards, for legitimate Research, quality improvement and scientific purposes.
Where genetic or genomic information is used or shared for Research, KDL may apply additional safeguards appropriate to the nature of such information and the applicable ethical, regulatory and legal requirements.
KDL will process Personal Data only where such processing is permitted under applicable law.
Depending upon the circumstances, KDL may process Personal Data based on consent, provision of healthcare or diagnostic services, compliance with legal or regulatory obligations, protection of vital interests, exercise or defence of legal claims, performance of contractual or pre-contractual obligations, legitimate purposes permitted under applicable law or another lawful basis available under applicable law.
Where consent is additionally required, KDL may seek consent through an appropriate mechanism and will maintain appropriate records of consent.
Where Research requires specific consent, ethical approval or other authorisation under applicable law, KDL will obtain or rely upon such consent or authorisation as applicable.
Withdrawal of consent will not affect the lawfulness of processing carried out before such withdrawal and will not require KDL to cease processing where continued processing is otherwise permitted or required under applicable law.
Where withdrawal of consent affects an ongoing Research activity, KDL will manage such withdrawal in accordance with applicable law, the applicable Research protocol and ethical requirements.
Employee App Data: Location and employee data collected through the Krsnaa Employee app is shared only internally, with Krsnaa Diagnostics’ organisational servers and authorised managers, as described in Section 8. It is not shared with third parties or used for advertising.
KDL does not sell Personal Data, Health Data or Diagnostic Data for monetary consideration.
KDL may, however, disclose or make information available to healthcare professionals, service providers, Research Partners, technology providers, laboratories, academic institutions, government authorities or other recipients where such disclosure or processing is permitted under this Privacy Policy and applicable law.
Where KDL receives consideration or other commercial benefit in connection with a permitted Research, technology, healthcare or scientific collaboration, such arrangement shall not by itself constitute a sale of Personal Data, and the relevant processing shall remain subject to applicable law, contractual safeguards and the purposes communicated to the Data Principal.

Such information may be accessed or processed from locations within or outside India where permitted under applicable law.
KDL will implement appropriate contractual, technical and organisational safeguards and restrict access to authorised persons having a legitimate need to access the relevant information.
Depending upon the nature of KDL’s services, technology infrastructure, Research activities and service providers, Personal Data, Health Data or Diagnostic Data may be processed, stored or accessed in jurisdictions outside India.
KDL may transfer, store or permit access to Personal Data or Diagnostic Data outside India where such processing is permitted under applicable law and subject to applicable data localisation, healthcare, privacy, confidentiality, contractual and cross-border transfer requirements.
Where KDL collaborates with Research Partners located outside India, KDL may share relevant data or information for approved Research purposes subject to applicable law, appropriate contractual safeguards and applicable ethical or regulatory requirements.

Where information has been appropriately anonymised in accordance with applicable law, it may no longer constitute Personal Data and may be used or shared for lawful purposes.
KDL will maintain appropriate safeguards against unauthorised re-identification or use of de-identified information.
KDL or its Research Partners may publish or otherwise disseminate findings, results, statistics or scientific outputs arising from permitted Research activities.
Such publications shall, where applicable, use aggregated, anonymised or appropriately de-identified information and shall not identify individual patients unless identification is expressly permitted by applicable law and the relevant consent, ethical approval or other lawful basis has been obtained.
KDL may also acknowledge Research Partners, investigators, institutions or other contributors in accordance with applicable agreements and research practices.
KDL may use artificial intelligence, machine learning, algorithms and other automated technologies in connection with diagnostic support, quality assurance, operational processes, Research, analytics, scientific activities and development or improvement of healthcare and diagnostic services, where permitted by applicable law.
Personal Data, Health Data and Diagnostic Data used for such purposes may be subject to appropriate safeguards, including access controls, data minimisation, de-identification or anonymisation where appropriate, security controls, validation and human oversight.
Where applicable, KDL will ensure that Research or diagnostic-support use of such technologies is undertaken in accordance with relevant legal, ethical, regulatory, clinical and quality requirements.
We retain Personal Data only for as long as necessary to fulfil the purpose for which it was collected or processed, or for such period as may be required or permitted under applicable law.
